Website Use
The Website is not intended for children and no person under the age of 18 may use the Website. If you use the Website, you are affirming that you are at least 18 years old or the legal age of majority in your state or province of residence (whichever is greater), have the legal capacity to enter into a binding contract with us, and have read this Agreement and understand and agree to its terms.
The products provided as is without any guarantees or warranty. In association with the product, NV NEW YORK makes no warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or of non infringement of third party rights. Use of the product by a user is at the user’s risk.
NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, THE PRODUCTS TO WHICH THE INFORMATION MENTIONS MAY BE USED WITHOUT INFRINGING THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS, OR OF ANY OTHER NATURE ARE MADE WITH RESPECT TO INFORMATION OR THE PRODUCT TO WHICH INFORMATION MENTIONS. IN NO CASE SHALL THE INFORMATION BE CONSIDERED A PART OF OUR TERMS AND CONDITIONS OF SALE.”
By purchasing an item from NV NEW YORK you are stating that you have read and understood the terms of service in their entirety and have the faculties to understand the said document.
Use limitation
You may not modify, distribute, reproduce, create derivative works from, or sell, any products obtained, from NV NEW YORK’S website.
Any attempt to modify and re-distribute the product itself is expressly prohibited by the Terms and Conditions Liability for such redistribution will not be assumed by NV NEW YORK or any of its associates or partners.
Assumption of Risk
By buying, using, or allowing the use of NV NEW YORK’s products, you understand and agreeing that YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED WHILE UTILIZING NV NEW YORK’S PRODUCTS WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF NV NEW YORK including but not limited to equipment malfunction from whatever cause, or any other fault of NV NEW YORK. Additionally, you agree to indemnify, defend, and hold NV NEW YORK’s products harmless from any third party claims arising from High Risk Activities.
Warning
Misuse of products sold by NV NEW YORK involves serious risks including injury, disability and death. Purchasers assume all risks henceforth from the moment they obtain the product. Any use of said products, incorrect or correct, the user does it at their own peril even if compliant with supplied directions or perceived user understandings of the product.
Inspect Before Each Use
This product must be inspected for use to ensure it has not been damaged in shipment. If damaged, do not use and immediately contact NV New York for a replacement. “damaged” is defined as a defect that renders the product unusable by the customer. If one fails to adequately inspect said product they assume all liability from their first use onward.
Entire Obligation
The PRODUCT LIABILITY DISCLAIMER document states the entire obligation of NV NEW YORK with respect to the products. If any part of this disclaimer is determined to be void, invalid, unenforceable or illegal, including, but not limited to the disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effect.
With Regard to Masks
NV NEW YORK sells non-medical grade masks made from cotton. They are not to be used with the express purpose of filtering air consumed by the customer. They are a face covering not designed to protect the user or others around them in any way. By buying said product you're agreeing and understanding this is not a medical grade mask used to protect any individual aforementioned. By agreeing to the terms of service you are acknowledging, agreeing, and understanding this statement in its entirety.
With regard to The Donation Program
NV NEW YORK donates one disposable mask for every purchase of a mask and scrunchie set. The “disposable mask” does not match the price, fit, or design of the products sold on the NV NEW YORK website and will be distributed at the discretion of NV NEW YORK to the Bowery Mission. Your donation will not be instant, it will be made at NV NEW YORK’s discretion at a time that they see fit.
